Incorrectly issued CCJ

Would appreciate some advice on this.

I checked my credit report a back in February. Not for any particular reason, more out of curiosity, and saw my score was a lot lower than I thought it should have been. I looked into this and it appeared I had a CCJ against my name.

I contacted the solicitors who had issued the CCJ and they said they were acting on behalf of a parking company who had issued a PCN against me a year beforehand that had not been paid. The only issue was it had actually been paid. I was able to provide a bank statement and a payment confirmation email from the parking company demonstrating this. It seems like either as a result of an oversight or just pure incompetence they still pursued a CCJ against me. I received no correspondence at any stage after I paid the PCN and only discovered this purely by chance.

I've spent the last 5 months constantly chasing the solicitors to get this CCJ struck from my record. I would often not receive a response to my emails for weeks and many of the calls I made to them went unreturned. I finally received confirmation from them this morning that the CCJ has been removed. Turns out it was actually removed back in June and they only just got round to telling me. I checked my credit score this morning and it is now back where it should be.

What I want to know is am I entitled to claim compensation for this? I didn't lose anything financially as a result of it, but the stress it put me through was considerable. I want to apply for a new mortgage soon and having a CCJ against me would have been disastrous. I emailed the solicitors asking for an apology from their client and they essentially told me to f-off. Is there anything I can do about this? Has anyone else had a similar experience and able to offer any advice?

Maje a subject access request followed by a formal complaint joint and several to the parking company and the Solicitors.

I might also write to The Court about it as they obtained a judgement for a non existent debt which might get them into a lot of trouble.

As you say yourself, you've suffered no material loss as a result of the error.

You can't go to small claims court in the UK for stress, or loss of time. There's nothing for you to be compensated for.

For someone to sue for stress, it has to have developed into a recognised psychiatric injury, clinically diagnosed and directly linked to some form of negligence of breach of duty of care.

A solicitor can't issue a CCJ (it stands for county court judgement). Do you mean something else? If so, you can complain to the legal ombudsman, but you need to follow the solicitor's official complaints procedure first.

The Solicitor will ask the Court to issue the Claim. I’m assuming this is what the OP means.

Agree that as you haven’t experienced any financial loss you won’t be able to make a claim.

I’m not sure what writing to the Court would achieve personally.

I did develop this in a different environment - a university - but eve then I wouldnt be able to claim and I have pTSD and physical disabilities from the psychosis from stress that I developed.

In your other thread, you said that your PTSD and physical disabilities were due to your husband being "so frugal". Doesn't seem relevant to the OP's problem (you said that, in your case, the CCJ was correctly issued).

t is a complex story and I dont want to say too much to avoid being identifiable. I was under intense stress with my research which was on a very sensitive topic which ended up relating to a big news story. finishing my phd there were multiple stressors but one of them was the need for me to use soem of our money to pay for interview transcriptiosn and books becasue I knew I codlin finish in time without this and was stressed from the other factors too. there were instance of me being bullied and also my work plagiarised by a senior Professor which all added to the stress. so it was a combination.

Solicitors act on client instructions. It’s not down to solicitors to ask this client “are you sure this fine hasn’t been paid? Have you double checked?”. You have no claim against the solicitors as they haven’t done anything wrong. You also have no claim against the parking company as you’ve suffered no loss and compensation for stress/hurt feelings does not exist in these circumstances.

If you want vengeance then you could write to the Money pages of newspapers about it, naming the company. Alternatively write to the company setting out your complaint and ask them what they propose to do to make it up to you.
