Hi

Sorry im not sure if I have posted in the right forum but im looking for some help before I respond.

I purchased an item of furniture via a website but the item is dispatched from the manufacturer. The item arrived and though I am pleased the top is damaged to which I requested a return and replacement. You basically raise a ticket and are given a few solutions; return and replace, return and refund, compensation. I requested a return and replacement providing photos of the damage. The request is then sent to the manufacturer.

The following day I received a response offering me £15 refund to keep or a new top sent. I declined both as I am not willing to keep an item where the damage cannot be concealed nor should I but something new and be expected to. I also feel it is unacceptable expecting the customer to dismantle the item and repair it themselves. Again this item was sold as new.

Today I get a response saying that a new top is on its way! Am I being unreasonable to not be willing to repair it myself?

After doing some digging it appears the manufacturer went into liquidation at the end of May so now my item doesn't even have a warranty which is advertised online as 12 months. I purchased it a week ago.

What are my rights? I want to respond as I am not happy that with the action they have taken but I need to know my rights or if I am being unreasonable and should just repair it myself?

If they went into liquidation I would be breathing a sigh of relief that I’ve at least got a replacement part.
not perfect but better than finding them gone and no reply at all

With regards to your rights, not many other than credit card protection. Did you pay with a cc?

It's tough to say without knowing the exact mechanics of it all.

If you have paid the website, not the manufacturer, technically your contract is with them so you could explore that option.

Infact you may have to do this before your bank will start the chargeback process.

If their website is simply a portal though, your contract may be directly with the manufacturer...your payment details should confirm this.

As far as the warranty goes though, you're going to have to write that off. Your warranty is with the liquidated company; you're essentially an unsecured creditor and would join the debt hierarchy. You're unlikely to receive anything.

Hopefully you can get your refund; just count yourself lucky that you were able to get the new part!
