Estate agent taking advantage?

Hi, my estate agent coincidently owns the other flat on my floor. I ran into bother when I went to sell my flat two years ago. It turns out, I have no lease plan and to make matters worse, the other flat's lease plan shows it to be where mine is. (Yes I will be pursuing thus matter with the original conveyancing solicitors.)

It has been an absolute nightmare. I have required my estate agents full cooperation in seeking a deed of variation. While he has had to cooperate, he has not paid out any money. That's a separate long chapter in my nightmare!

This process is coming to

an end soon and we should be able to submit revised lease plans to land registry soon. With this in mind, I have approached estate agent to put flat back on market. He's said that's fine but he'll need to send out new agreement paperwork. I feel very strongly that he will up the commission percentage that we previously agreed because he knows he has me over a barrel. I won't go into why I think this but thete have been a few professionally grey areas in our dealings.

What can I do if this happens? Nothing until after I have my new lease plan and my flat sold right?

If you don’t like the commission he’s charging then use another agent. Maybe wait until the DoV has been sorted out first though.

Just to check - did you sign an agreement with the agent previously? If so, you need to see what that says about cancelling that contract that you have with them.

Thanks for your reply. Yes that's what I wanted to do but with the way the market is I thought I'd better get it on soon. I have to complete by last week in November or I will lose the chance to claim stamp duty back on current property. Three years have passed since this mess began. It is exhausting.
