Can I ring fence my inheritance?

Marriage has been awful for years, should have gone by now but stayed for the kids etc. I’m about to inherit, can I ring fence it?

There’s plenty when it’s the other way round. Perhaps you didn’t know.

I have sympathy, OP, but you did decide to stay.

@PersephoneParlormaid as a starting point put it into any account which is solely in your name.

Certainly do not co-mingle with any joint accounts you may have with him.

Is there a big differential between his invested inheritance and the one you will receive?

Put it in a sole account and do not use one penny on any shared family or household expenditure.

Once you start spending it on anything joint or shared it will be seen as a marital asset

How soon are you due to inherit?

Had probate been granted?

I would ask a solicitor if it would help to start divorce proceedings before you inherit!

Keep it in an account in your sole name, don’t use any of it to pay anything marital related or bills anything. Find a good solicitor. All finances will be laid out during the divorce if you’re going for a clean break. It depends whether you live in Scotland or the rest of the uk. Also on the amounts you’re talking about. Following with interest, going through this myself.

Speak to a Solicitor to see if a Deed of Variation is possible, if so monies can be paid into a Trust and you can draw money out of Trust via a loan, the assets belong to the Trust and cannot be claimed on in divorce proceedings.
