Does anyone know about RIDDOR and near misses?

I was in an accident at work. A fire door started to fall apart and I was cut by falling wood and nails, and a piece of safety glass hit me on the head. I saw a doctor and had a minor head injury and concussion. I was signed off work for 7 days.

I asked for a copy of the accident report. In it it says that this incident is not RIDDOR reportable, and it was not a near miss.

Upon my return all fire doors had been mended. The door that collapsed on me had been continually referred to be fixed, but not signed off due to £.

My Q is, would this incident be reported under RIDDOR, and why is it not a near miss when many of the other doors are not secure?

I think it would have maybe been reportable if you had to be off longer than 7 days or if you had been more injured, fracture etc

RIDDOR need more than 7 days off and some specific injuries such as broken bones etc. You can google this easily.

Not good obviously but it is reserved for more serious injuries. Can you raise it with a workplace safety representative?

Wow where do you work?! If you were off for over 7 days it should have been reported but over 3 days only recorded, I believe but am
not an expert. I can’t see why it wouldn’t be reported as a near miss though. Have a look on the HSE website they have lots of guidance.

No it's not a near miss but it's reportable under the 7 days off work rule.

If your work refuse to report it, call HSE yourself.

If they aren't your enforcing body, it may be the council but HSE will advise.

If you had been off work one more day it would have been RIDDOR reportable.

Saying it wasn't a near miss would mean they've categorised it as an accident or incident. A near miss is where someone nearly gets hurt but doesn't, in this case you were hurt so not a near miss.

She had 7 days off so it's not reportable, you need to be off more than 7 days.

You injury is probably in the grey zone that could be reported by someone very zealous but I think that your company’s reasoning is correct. I wouldn’t have done so - although you were signed off for 7 days it doesn’t sound like you were incapacitated for that time and your injuries luckily weren’t more serious- no fractures etc.

It definitely doesn’t count as a near miss. A near miss would be an example where but-for-luck a very serious/fatal injury would have occurred. An example would be a gas canister explosion at night, which would have killed the team if it happened during the day.

If the door which injured you hasn’t been fixed that is a seperate and serious issue. I think that you should speak to HR about getting it fixed.

I was off work for 9 days in total. I had 2 days off sick, then my sick note started for the next 7 days.

RIDDOR is on injury or days lost, however the 7 days lost is counted from the day after the incident, so could have fallen just shy of triggering a report OP.

ETA; cross posted, with 9 days it would be reportable. You can contact the HSE yourself.

I'd report it to the hse or your local authority and fire brigade if this is in the supermarket if you posted before,
