I recently placed an order for some garden chairs which were reduced in a sale. They were showing as in stock and the company contacted me and arranged a delivery date for the 5th of June. The day before delivery was due they phoned me and said the chairs were no longer in stock and they didn't have a restock date. The chairs are now showing as out of stock on the website and are also back at full price.
I decided to purchase something similar from a different retailer instead and so the next day (Friday 6th June) I emailed and asked to cancel the order. They responded to say they would issue a refund via credit note rather than to my original payment method.
I've emailed back and asked if I can have the refund back to my credit card as they were unable to fulfil the order within my expected timescale. I've been told this has been escalated to a senior advisor but I haven't had a response from them yet.
Does anybody know if they can legally do this? I've had a look at their T&Cs and can't find any mention of refund by credit note for cancelled orders or sale orders. There is a list of reasons why refund will be by credit note but neither of these is listed.
I paid by credit card so I'm not sure if this would qualify as a dispute e.g. item not received.
