NDN cut down a tree in my garden

NDN is building a fence between their garden and mine. The people doing the work cut down a tree that was entirely in my garden and damaged some other plants. The tree was about 15 years old.

What can I do?

There are other issues, but that is a separate thread (in Property/DIY).

So are they going to claim it damaged their property and end up taking you to court?

Get in first, speak to the police about ALL of it, before you find yourself hounded out and financially bankrupt. File a report tomorrow.

I'd report to police just to have a report on file. Take photos of the break and the tree.
Tell the neighbour that you have a garden camera and so you will be able to see what happened. That will probably put the frighteners up them

You know that, they know that, but if they have photographic evidence of your tree lying in their garden... who will the judge believe?

Even with you saying they cut the last bit if they took photos of you starting to cut it down how can you prove it was them? All you can prove is that it didn't snap but was cut.

Time to involve the police, you are in a very vulnerable position right now.

Your only recourse is probably to sue them for damages but that will cause a problem when you come to sell the house. It won't bring your tree back either.

It won't cause a big issue when they sell.

My landlord had to do this when the NDN cut down a tree in our garden. His lawyers wrote a letter, he negotiated a settlement with the neighbour (cost of a replacement tree). End of story.

He sold a couple of years later (we had moved out by then)

Most people aren't going to be frightened off by a dispute of this nature even if it has to be declared

  • get some CCTV installed asap (just simple ring cameras or similar)
  • speak to a lawyer asap

Our ndn attacked our new fence with a claw hammer... Solicitor charged me 75 quid to tell her to not touch my property.. They moved soon after...
