Signing over a property.

Can someone tell me is it possible to get an ex partner to sign over his half of a property. An agreement was put in place by a solicitor, I signed my side last summer but the solicitor failed to get him to sign his half of the agreement. The ex partner does not have a solicitor in place any more. How would one go about getting him to sign ?

If he won’t sign you would have to threaten court to get your equity and prove you have an equitable interest. No solicitor can force their client to sign a document they don’t want to.

Thank you for your reply Theabrandt1. I had a feeling that would be the case. I suggested taking him to court, but he wasn’t keen as he acted as a notary for him for other property that has now been dealt with. It’s hard to find a notary so he did it to try and move things along !

A notary? Are you overseas? It’s not up to him if you take him to court and of course he won’t like it! He doesn’t want to sign if it means him giving you half a house he wants to keep. If you have paid into that house he needs to understand you do have equitable rights to it and you will go to court to enforce those rights.

There were 2 properties in Spain which have been dealt with. And one small house here in Uk. All were bought with my money, but all were both in our names. We were not married. So sounds like it’s court time.

Is it possible he would ignore court summons and/or not turn up ? He hasn’t made the process easy at all so far. The agreement was that one Spanish property would go to him, and one for me to sell, which has sold, and the uk place would be put solely in my name, and this is the bit that has not been done. We don’t know where he resides when he’s in the Uk, so all communication is through email.
