Probate question

My dad is currently at end of life. I'm the executor for his will. There is no 'estate' as such, house is social housing, savings are under £10k. These are currently in a joint account , mum resides in a care home, sister has literally just had deputyship granted for mum as she haa a bank account which receives her state pension. No power of attorney etc.. do I have to apply for probate ?

No, any money will be passed onto mum in the joint account, sorry your parents are in this situation, just hope they are both comfortable. Have you seen your dads will.

Yes, I have the will at my house as my mum now has advanced dementia and started to destroy documents .
It's a very simple will, all money passes to my mum, a couple of different collections of items that he has go to the grandsons.

No, she hasn't, she flatly refused to do so and then lost capacity to make those decisions. There is no estate in her case anyway.

In that situation the intestacy rules kick in and any money will go equally to her children.

No you don’t have to do anything. When you register your father’s death, the Registrar will offer a “tell us once” service, that will cancel pension etc. The bank may ask to see death certificate to take him off the joint bank account, also if he has any other private pensions, you just need to send them a copy.
