Boundary line issue on drive

Moved in 5 years ago. Neighbours moved in 15 years ago. Neighbours have to upkeep the right and we are the left. They drop down lower than us on the right. There is a slither on land on what we think is our side level with my drive (as they are lower down we are on a hill) she called my DH a baboon for pulling up plants that were embedded in weeds on said slither of land amongst a honeysuckle bush that she told us she planted. Found our title deeds plan before the hoise built in 1920. Our plot and the neighboir the other side has said measurement on this title, we measured it and that slither of land is on our side. Right hand side is adamant it’s theirs and keeps planting stuff there and DH keeps pulling it out. . Honeysuckle bush is now growing wild and scratching my boot on the car. DH has had enough and said now he’s going to dig it all up and cement it and it’s just going to escalate. I can’t reason with him over this.
he also going to put up a 6ft fence right the way down the garden in front of their fence as he doesn’t want to look at them. Currently a 3ft fence with trellis.
Is DH being unreasonable to remove the honeysuckle bush and cause chaos
I’m fully aware if we having a massive falling out we will have to declare it when we sell.
I said he should speak to them calmly and he said he can’t even look at them since she hammered down our door and called him a baboon 🙈
in the image the green line is the end of the measurement on the paperwork we found. Land behind the red line they think is theirs.

Personally I’d put something in the ground that would kill the plant and stop other things growing there. Neignour would be non the wiser- likely a no-conflict solution. If there’s plants clearly encroaching on your side you can just cut whatever is growing on your side.

Plan before house was built. We measured it and it’s correct which takes us to the green line

Trellis they put up. Bush they planted. But that area behind the red line is in line with the rest of our garden and our level. They drop down by about a foot.

Honestly - life is too short. I know it’s the principle of the thing etc etc, but it’s just not worth a war with a neighbour over a sliver of land that size.

If you do decide to go to war, check your deeds and the council planning dept re a 6 foot fence - and be prepared for the cost and ongoing maintenance.

I don’t know actually. I’ll have to check 😩 he wants to put. 6ft fence up the entire length of the garden so in effect there will 2 fences back to back

So the deeds specifically say something like "the frontage of the plot is x feet from this particular point"?

Just having a very quick look at those photos (and based on absolutely nothing else) it looks as though the wall may be a joint boundary wall or may sit on your neighbour's property and be their wall.

In either case, I would suggest that anything on your side of that white painted wall is part of your property. If there are plants on your property then you can certainly pull them up.

On what basis does your neighbour claim that the bit between the red line and the green line is theirs? Do they also have something in their deeds which mentions a certain length?

Trim the bush back. You're allowed to do that. The plants I couldn't care less. Let them crack on.

I missed this bit. @CatsorDogsrule is quite right to raise this issue. You can only have a 1 metre high fence abutting the highway (or pavement) but how far back that needs to go depends on the particular council.

It is likely that the first one or two metres closest to the pavement will have to be just 1 metre high, but further back you can raise the height to 2 metres.

I know exactly how you feel - we’re in a similar position and it’s horrible. We used to get on really well with our neighbours and now things are frosty. It’s awkward and very sad after many years of living next to each other. My advice, from experience, would be to let it go. It’s stress in your life you don’t need.

I copied the plan and dropped it round there. They they went outside measuring a couple of times. They haven’t provided us with anything and just keep planting stuff on that tiny bit of land which we think is our side. One of the photos shows their drive and wall lower down than ours.

You could contact them for advice. I would be extremely surprised if the land was theirs given they have a solid boundary wall.

Yes this is exactly it. They got on well with the neighbours 2 previous to us and did it together pulling up all but one of the original metal fence posts that went right down 120ft. There’s one left up the side and if that’s anything to go by it’s clearly our land.

They’ve planted the bush directly in the middle of the trellis fence and it’s grown inbetween it. The trellis fence has been plonked in the middle of that slither of land

If they had done that, then that wouldn't have been so much of an issue. But looking at one of the later photos it appears that they have erected the trellis on the OP's land and not on top of the wall.

Yes they have their wall. Then that slither of land level with my drive that they then put a trellis on and planted the bush. We moved in and nothing was said until we pulled up the dead plants on what she said is her land.
she thinks she has the wall and the slither of land
