Help for neighbour on skilled worker visa

Hi,

I hope that someone is able to help with some advice for my neighbour who is currently facing having to move away due to her employment position.

She came to the UK on a skilled visa having been offered a full time permanent job in the care field. She had her first child last year (he is about to turn one year in the next few weeks).

She is due to go back to work next week but her employers contacted her this week and she has been given 3 months notice to terminate her contract (and so in effect, her visa also). I’ll attach the letter the was sent- it mentions that she never disclosed her pregnancy but she did this at 20 weeks, so within the legal timeframe she had to do so.

I feel they may have shot themselves in the foot by mentioning her pregnancy as obviously they cannot discriminate against her for the pregnancy, but other factors are mentioned also.

Unsure if anyone will be able to offer any advice- obviously things are tightening up with healthcare visas and so the chances of her getting a further job in the UK offering sponsorship are incredibly slim. It just seems so sad that she has skills to offer and has made a life here and may be forced to leave the country in a few months. Her current visa is not due to expire till 2028, but is obviously connected to her job.

IMO and have some experience with this, the best option for her in terms of renewing her visa, is to secure another job - care roles are often available, for her partner if she has one to also be in employment and to seek legal advice in respect of the issue of when she declared her pregnancy- keep any email trails etc now while she can copy these.

Yes and no- she wasn’t pregnant when offered the job, her visa started from July/ August but it took time to get her in post so she didn’t start until she was in first trimester

Thanks- she’s actively looking for other jobs but with the change in visa regulations, most care jobs do not offer Tier 2 visas anymore. Her husband has a full time job but again, no visa sponsorship (he is on a spousal visa currently).

I’ve advised her to get further advice regarding her pregnancy/ dismissal but unsure of how her working on a visa will affect her rights in this regard.

So she's here on a work visa but has sent most of that time on maternity leave 🤔

I mean, this is absolutely what the new rules are designed to stop. One care job - which she has done for a matter of months - should not let in three people.

I don't really understand the full situation
She got the visa for the job in July/Aug last year ? But didn't start till after that ? But her child is about to be 1? That means she was pregnant when she got the job.
I am not an immigration lawyer so frankly she'd need to consult them to determine whether what the company saying is legit. But as PP said, best bet is to find another job. Can the husband find a sponsored job so they swap visa status ie she is on spousal and he's the main visa holder.
Frankly they were always a bit precarious position having a baby so soon after securing a role as she'll have barely passed probation before going on mat leave.
