Does anybody work in council planning enforcement?

query for staff who work in planning enforcement. - can you apply for retrospective ‘change of use’ for land you do not own? Or is this not possible

Yes but you have to serve notice on the landowner

Notice should be served on the Owner before the application is submitted, and then Certificate B completed as part of the application stating who noticed was served on and when.
If it comes to light during the determination period that this has not been done, then it can be done at that stage, but the application cannot be determined until a period of 21? days has passed.
Alternatively, Council could declare the application to be invalid and refuse to determine it unless resubmitted correctly. Obviously if this is a retrospective application, there may be enforcement matters to consider too.
However, Councils don't have land ownership records and don't check ownership . It will only be if owners come forward saying they haven't been notified that these matters come to light.
