LEASEHOLD/SERVICE CHARGE DISPUTES

I bought a flat last year and was told in lease pack forms that were answered that one leaseholder was often late paying there service charge and basically didn’t adhere to some covenants in the lease. That was it. There is a management company that is responsible for the property.I was never told that there was a long ongoing legal battle with them and the management company and directors were being taken to a First Tier Tribunal. Also they answered “No” to the service charge going up in the next 2 years. Well since January I’ve been asked for nearly £7K this is just my share. There are 6 flats in the building so as you can see a pretty substantial legal bill. I am disputing this as mainly don’t have the money but more so I was never told the full facts as had I known this was to come I wouldn’t of bought the flat or would have adjusted my offer accordingly.

I now wish to sell as I can see there is going to be long term problems here and quite frankly I don’t trust them. They know I can’t afford it but have said it can come off the completion price when I sell. I mean it’s a bloody cheek as the only reason I’m having to sell is because of there miss management. This has really put me off leasehold. So I want to go back to a freehold property and will just have to get a stair lift installed as this is the reason I moved here in the first place to a ground floor flat, is because I can’t afford a bungalow so bought a ground floor flat. Im going to struggle on a flats budget but they have really left me in a mess.

How can they do this? I am contesting it and have sent letters to them. I know they are waiting for the tribunal decision before responding which could be another month yet. I’m at my wits end.

Hi. Thanks for replying. I had a phone appointment with Lease Advisory Service but didn’t find them very useful. They basically just said “it would cost thousands “
