Is it right that if you were sick Mon- Fri but only work 3 days weds to Fri you don't get any sick pay for that time?

Depends on company policy but many do not pay first few days.

You only get paid for days you would have worked and the first 3 are unpaid, so in your example you wouldn't be eligible

When did you call in sick? If you notified them or signed the self certification form as being ill on Monday you might have a point.

There is no discrimination here.

Many companies do not pay sick leave for the first three days. Statutory sick pay is not paid for the first three days.

If you work Monday-Friday (5 days) and are off for that whole period, your first three days of sickness are Monday-Wednesday. You will receive 2 days SP/SSP for Thursday-Friday.

If you only work Weds-Friday (3 days), you will receive zero SP/SSP, as your first three days of sickness are Wednesday-Friday. If you had not been off sick, you would only have received wages for Wednesday-Friday.

It's irrelevant. Her first rostered day of work was Wednesday. SSP eligibility would only start on her first working day after Friday.

SSP is only payable for qualifying days, (the days you usually work). Your first 3 days are waiting days so if your first working day is a Wednesday then Wednesday to Friday are your waiting days and your SSP only kicks in after that.

Your employer is complying with law. It does favour a FT worker though - raise it with your MP or start a petition
