Can a conveyancer please give me some advice?
Mum died years ago. Stepdad more recently.
Tenants in common, declaration of trust, etc.
Stepsis refusing to sell house. Form A restriction at Land registry. Is there a stronger restriction as she is full of vitriol and will stop at nothing?

Force a sale through the courts is your only option, so you need to see a solicitor who litigates.

CalmBlueCritic · 18/04/2025 10:07

Thanks for replying. No money for that, which is why I would like a stronger restriction.

Can you request she buys you out? Why won't she sell? Or is she living in the property?

Can the probate solicitors encourage the sale?

Sorry for all the questions!

What do you mean by a stronger restriction? What would you be looking to achieve? The Form A restriction prevents a single trustee from selling the property. If she won’t sell then the restriction is irrelevant.

It sounds like you want her to sell the house. As the previous poster says, in that case a restriction is irrelevant. That prevents a sale unless the conditions outlined in the Deed of Trust are met. You can't get a stronger restriction, nor can you use a restriction to make her sell. If you want to force a sale, the only way you can do that is through the courts.
