Could anyone tell me where i stand when a closed facebook group of my local crime site has published photos and of children speculating about littering just because they saw them leaving an area.In the grand scheme of things it’s not huge but wondered if i have any rights to take this up with their team and have it removed?

Have you asked them to remove it?

CaptainFuture · 18/04/2025 06:42

Did they do it?

If the children are identifiable, that is likely to be a breach of GDPR. That doesn't give you any rights unless you are a parent of one of the children. If you are, you can insist that the photos in which your child is identifiable are removed.

its not if the children are in a public place. https://www.avonandsomerset.police.uk/report/taking-photographs-in-public-places/

Report someone taking photographs in a public place | Avon and Somerset Police

There is no law preventing people taking photographs in a public place, providing they are not considered to be indecent.

That link is about taking photos in a public place, which is allowed. It does not address publishing photos where the individuals are identifiable. That is not a criminal offence, but it may be a breach of GDPR. So I'm afraid you are wrong. It doesn't matter whether the photos are taken in a public place. If the children are identifiable, publishing the photos online may be a breach of GDPR.

Thanks for your help. It’s been removed but i’m still cross as the damage is done. Still waiting for their admin team to come back to me but so far no reply. Not sure i can take it any further
