Given Section 21 for repairs but landlord wants me back in July?

Hello, new here so hope I am in the right place!
My landlord has issued me a Section 21 notice which expires in May. Along with the notice, he emailed the agents saying that I am more than welcome to move back in in July.
The landlord was served a council warrant for repairs in Aug which he carried out. I had six months protection from eviction and the Section 21 arrived shortly after. He said he is issuing this to do a refurb of some of the house.
My question is this: Do I trust that he would have me back in July?
The agents emailed him asking him what the rent would be and whether he could give me a definite date to move back in, and that was three weeks ago- no reply.
I'm in a panic because although legally, this cannot be classed as a retaliatory eviction, it still feels like one. I have nowhere to go with my children for two months and nothing has been put in writing.
I have health issues and have lived at the property for five years, and spoke with a housing officer at the council yesterday who advised me that it will be a long time, (3 years roughly) before we get housed with them and that my best option was to negotiate with the landlord.
Please can anyone advise? Do I trust that he will have me back and leave voluntarily in May? Or, stay in the property and hope that the council will help?

Even if you have been served with a valid notice then it's unlikely likely you would even be out by July.

S.21 eviction takes longer than that.

It's not any kind of eviction. What the landlord actually wants is for you to move out temporarily while repairs are completed. That's not a good idea from your perspective so you need to go back to them and negotiate a way for repairs to be completed with you living there. If the landlord actually thinks you will have to move out in May then he's an amateur! Whatever you do don't move out of the property. If the landlord wants you to leave he needs to pay for alternative temporary accommodation and you need to keep your belongings in the property but I wouldn't do that either TBH in case he tries to pull an illegal eviction.

I wouldn’t be surprised if he also attempts to increase the rent quite significantly when you attempt to return in July.

I would completely ignore this and follow the council advice if you are unable to find somewhere suitable to move to in the meantime.

Thank you for your information.
The notice is valid unfortunately. So I would have to resign a brand new tenancy in the July which means (according to the agents) that after May he is no longer my landlord. That gets him out of providing any temporary accommodation for us. Very clever.
Its like dangling a carrot; if I don’t vacate in May, he could take away the offer to move back in in July!

This is a worry of mine. I have a feeling that’s the real reason why the notice has been served

The LL has to issue a claim for possession at Court and they cant do this until the s21 expires in May. He is still your landlord unless he has sold the property (which doesn't sound like it) The s21 does not end the tenancy.

You’re in a difficult position, you could stay post May and let him take it to court but then you’ve no chance of him having you back in 2 months. Personally I would start looking for something else, it’s not worth the stress or uncertainty. I know that is easier said than done but I wouldn’t want to put my trust in him having you back. If it does go to court the council will have to house you but that could be in any type of temp accommodation.

The notice might be valid but it doesn't mean you have to leave! It doesn't end your tenancy.

Unfortunately I don’t ’qualify’ to rent with letting agents anymore due to the fact I am on disability benefits topped up with UC. They say I can’t afford the rent (even though I’ve private rented for 20 years and never once been in arrears).
I guess the only option is the council.

Are you reading what people are telling you about the s21? It doesn't end the tenancy. You don't have to move out in May. You have to negotiate with the landlord to stay while they do the repairs.

This would be discrimination, I know it’s happens but there are decent landlords out there who will rent to you in your position, it just takes time to find the ones that will. Good luck.

Yes, I know it doesn’t end it officially, he will have to evict me. The agents replied to his ‘offer’ email three weeks ago, asking what the rent would be and to confirm a moving back in date. They also asked if he would consider me staying whilst he carried out repairs but he has not responded!

I guess I’m frustrated because the council are delaying my application due to this offer but I’m not sure he means it by his lack of response. Quite worrying.

Then as soon as the eviction protection ends he serves you with a section 21. Saying you can come back after the place has been sorted . I personally believe he's doing that so you leave with the section 21 request so he does not have to go the full eviction route its just to get you out faster.

And if you do leave before eviction the council could then say you made yourself homeless by not staying after the section 21. The council could then refuse duty.

If you was to go through eviction the council would then have to put you into temporary accommodation. 3 years feels like a long time but its really not you could get an ok place it won't be perfect . But it could be ok . And of you was to get social housing you would not have to worry again or go through something simlar

just can’t believe people can be so mean sometimes! But you’re right, it could be ok.

I'm sorry it must be really stressful . I have slso been through eviction. To be honest I saw it as a positive. Almost like a journey to my forever home where I would never have to worry again. I just don't want to see you in a bad position with the council because of him.
