*Sigh* Ford Kuga Purchase Distress-Can anyone Legal give advice please?

I've put a deposit (£100) on a used Ford Kuga Phev on Saturday, only to see that Ford have just made a massive safety announcement telling all owners to only drive them on the petrol engines-until further notice! The batteries have been overheating, and they don't have a software?? fix yet.

Wondering just where I stand legally, I've paid the deposit to the dealer, read the purchase details they emailed to me, confirmed by email I wanted to go ahead with the purchase.

My whole reason for getting it was to make use of the EV miles, without this it's just a heavy expensive to run lump of metal, Aaaargh!

Any good legals out there who wouldn't mind giving a bit of consumer advice? Thanks

Deposits aren’t usually refundable, that’s the point of them. £100 is not ideal to lose but it’s not like it’s thousands. Just don’t go ahead with the purchase and find something else.

Is this a Ford Main dealer? They should just refund you the deposit. Speak to Ford Customer services if they won’t - you’ll get it back. The terms of the deal have materially changed since you cannot use all of the vehicle’s functionality. If it isn’t a Ford main dealer, just walk away if they won’t give you a refund. If you paid the deposit by credit card your card company should be able to help you.

Whether this is a Ford dealer or not is irrelevant and the other advice on this thread is also incorrect. A dealer cannot legally sell a car with an outstanding recall until the issue has been fixed. This applies to any car dealer, not just main dealers for the brand in question. OP should get her money back unless she is willing to wait until Ford come up with a fix.

Come on now, if we're going down the route of childish acronyms there is one for every car, even your beloved Japanese manufacturers. It's hardly helpful is it?

OP, speak to the dealer in the first instance. Would you be happy with the full petrol version or another Ford? That route could be the simplest.
But @prh47bridge answer nails it.

Make up all the acroynms you like for Toyota, Lexus and Honda - they will ALWAYS be infinitely more reliable than anything Ford makes.

Which still brings absolutely fuck all to OP's predicament. Time and a place to air your grievances, but the thread of someone who needs help isn't that time or place.

If you cant get your money back (and I cant see why you wouldnt frankly), write it off and be grateful you saw the alert about the Kuga issues before you got lumbered with a POS car.

Much better alternatives out there.

What you said was not advice. Its just word salad.

Stands to reason the OP is in contact/communication with the dealer (as the OPs post indicates re email etc).

Speaking to them is not "advice". Thats something the OP is doing anyway, whether by email or whatever other method.

But by all means, continue digging if you think what you said was advice.

Regardless of the safety issue I'd just walk away, you say that you want the benefit if the electric miles but these are ridiculously low with the Kuga Phev. If you want electric miles but a cheap secondhand EV there's plenty around.

Thanks all for your helpful messages and advice- and to update, yesterday I contacted the dealer (it was a Renault dealer, a Ford car they'd had as a part exchange).
Advised them I wasn't going ahead with the purchase, sent a follow up "not fit for purpose " email and requested my deposit back. Won't hold my breath, might chase it up next week.
Feeling lighter and brighter after this, and decidedly like I'd dodged a Ford Phev shaped bullet, I went out yesterday and put a deposit on another car- VW T Cross for anyone who's interested.

If anyone has horror stories about VWs, please leave it a day or so ;)

VW as a brand tend to score well below average in most reliability surveys these days. You were given good advice to buy a Toyota.
