Garden Ownership

I live in a block of four flats, which were previously owned by a social landlord. One of my ground floor neighbours has diligently maintained both front gardens for several years. The previous owner of the other ground floor flat was an elderly woman who has since passed away, and her son has now inherited the property and is renting it out privately.
Until recently, I wasn’t aware that these gardens were considered privately owned and were included with the purchase of the flats. This hadn’t been an issue since they were well cared for, and I had no concerns.
However, the new' landlord 'has decided to bulldoze the other ground floor garden to cut maintenance costs. This has made me question whether he actually has the right to do so. Is there a way to verify ownership of these gardens? No one else in the area who has purchased a flat seems to have acquired a garden, so I’m unsure why these two properties allegedly include them.

Is it not ground floor flats have front garden, 1st floor ones have the back?

No. As far as I am aware the rear gardens are communal. That's where the bins are kept and people dry washing etc.

You need to check the land registry as to ownership. In a multi-unit social housing the tradition would be to have community spaces for laundry cloths lines.

So the usage may not have been there as the gardner NDN took the space over.

The woman who maintains the gardens, while she does a fantastic job keeping them in great condition and the building spotless, also gives the impression that she acts as the building manager. I’m starting to wonder if she has simply decided this herself and led the other neighbour and consequently her son to believe it as well. And this is now back firing.

You need to get copies of the leases for those flats from the Land Registry.

Just got a copy of the title plan and its showing the flat in blue and the front and both rear gardens with red boundary line on it ?

Plan to which title OP? The freehold? As a bare minimum, you need the freehold registers. You really do need the leases though.

YesThatsATurdOnTheRug · 28/02/2025 09:56

Can you post the titles/plans on here?

Pigeonlives · 28/02/2025 11:12
