My elderly uncle has met online, then married a woman in Thailand. He has only been there for a few holidays and didn’t inform his family about his last trip, kids only found out he was over there when seeing his wedding pics on Facebook!

I believe the reason for the marriage was to get her into the UK to “look after him”. They had previously been denied a visa to visit, so got married for a better chance with a spouse visa. She has never visited the UK.

Obviously everyone really upset, and actually worried for the poor woman being “bought” by this selfish old man.

Unfortunately, uncle been really unwell in hospital a few times recently and he seems to be going downhill fast.

He is adamant his estate should go to his grown up kids, not his wife of six months. No will has been done, but he is aware this needs sorted sooner rather than later. A lawyer has been contacted.

My Q is: can he actually leave nothing to his legal wife? Would she be able to make a claim to overturn his will? They have never lived together, it’s just been him going on holidays to her country, they stay in hotels over there. Not in her home.

He is in Scotland if that makes a difference?

My father married an illegal immigrant from the far East, came on a student visa. She was younger than me. He was 74, she got everything as the marriage invalidated his existing will. Me, my siblings and DM got noting. Dad died quite soon after the marriage, she got his pensions and a UK passport...we looked at appealing all this but too hard and expensive.

I can see this happening in slo mo! He’s had six months of various hospital stays, but has still not sorted his will.

He’s verbally given instructions to his DC, but what use is that?

I think he thinks his wife wouldn’t bother with his assets as she loves him, and wouldn’t expect anything due to the short marriage.

Hmm 🤔 Ive said this before….. No fool like an old fool!

@Elvisse sorry, this is exactly the same scenario. Dad married her here so a completely legal marriage. There was nothing we could do. Immigration were not interested. Dad was 74 she was 34, I heard she brought her family over now. She got his state and work pension, my poor mum...🙁

Yes. Absolutely been trying! But wasn’t sure if he could legally exclude his wife, and she could contest anyway.

I don't know the answer to that, but from what you've said it can't be much worse than what the intestacy provisions would do!

although my uncles first wife and mother of his children wouldn’t be entitled to his pensions as they are divorced. They would have ceased on death, but his new wife might be able to claim? Wonder if she will get his state pension?

Obviously he’s not dead yet, but What a mess!

Yep! Thought he was going to have a partner cum nurse to soothe his last years, but without the accompanying legal rights.

Even if she had lived here in his home for a period, it would not seem so facile. And met his family and friends etc.

but it’s all been for nought.
