After fruitlessly searching for a driving test cancellation, I signed up to one of those companies who searches for you. However I got a message back saying my driver number/test reference were incorrect - I re-input them 3 times and still got the same message. So I decided to cancel the subscription rather than pay for a service that wasn't going to be able to help me. I had to Google search for their email address as there were no details on their website.
I asked for a refund but they have refused, saying this...
"In line with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, You are entitled to cancel your purchase and request a full refund of your payment, within 14 days from purchase, provided the Service has not yet begun. For the avoidance of doubt, the Service starts as soon as We start searching for alternative practical driving tests for You. This process will ordinarily start immediately after payment and the required search details have been received from You"
I told them I disabled searching as soon as I saw their message telling me they'd be unable to monitor for test cancellations with my allegedly incorrect details (it's an auto-booking arrangement) but they said they searched anyway. It would have been no more than 5 mins because all of this happened as soon as clicked 'pay'.
Surely the 14 day Distance Selling Regs overrides their Terms? They can't make me pay for a service that wouldn't have been able to help me?
