Court summons for speeding ticket

ive really messed up here and now am panicking

My husband was caught speeding in my car. Stupidly I somehow didn’t realise the letter was addressed to him after he’d opened it and showed me, so I filled out the form genuinely thinking I was the registered keeper (I’m not).

the next form was addressed to me and I was late send this back due to a hell of a lot going on in my life at the time and be just being overwhelmed and quite frankly stupid. I rang the number and they gave me a 7 day extension and said just send it now and don’t worry.

husband received his form and confirmed he was driving at the time.

we’ve now received a court summons as this whole process has taken beyond the amount of time allowed for police to deal with the matter and I’ve wrongly named myself as the registered keeper/filled out a form addressed to my husband.

In realise this is beyond idiotic but was a genuine mistake. Ive messed up every part of this process and have got into such a state with it. I’m a good person, clean lisence would never do this intentionally.

im panicking now but am told all I can do is wait to hear what the court decide.

How much trouble could I get in?!

Who has received the summons?

The letter would have automatically come to the registered keeper of the car, if this was your DH then the letter would have come to him and he would have a chance to name the driver (if it wasn't him driving for instance), are you saying you put on the form that you were the one driving?

If no driver is named then the registered keeper would be responsible for any prosecution.

So have you told them you were driving or have you filled in something that said you were the registered keeper of the car at the time of the offence?

Also, what speed was he doing, and in what limit?

Wanttohelpbuthow · 13/02/2025 20:54

I haven’t said I was driving (I wasn’t) I just said I am the registered keeper and that my husband was driving.
the only error is that I’m not the registered keeper.

he was going 61 in a temporary 50 average speed check. He already has 6 points (!) I have a clean lisence.

my husband received the summons but it’s a SJP

But my error and then my delay sending the letter back has made it go over the time limit

the only error is that I’m not the registered keeper
And you didn't send it back in the timeframe. I think I'd assume that's why you are being summoned rather than the registered keeper debacle.

I'm not sure I'm really following, is this what happened?:

So you got a notice of intended prosecution (NIP) and you, thinking you were the registered keeper of the vehicle, filled in the part that say 'I AM NOT THE DRIVER' with your own details and then filled in the next section naming your husband as the driver? Did you send that back within 28 days?

What was the 'next form' that you received in your name? What did it say?

Your husband then received a form asking to confirm he was the driver, which he sent back? Was this a NIP? Did he fill it in correctly, pay the fine and send it back within the timeframe indicated?

Now he has received an SJP notice which you haven't replied to yet?
