Hypothetical question -child maintenance

As above - is there any reason a person cannot buy car wheel clamps to use in a situation where child maintenance isn’t being paid?
it has now reached the thousands and the child maintenance service are on the case but by their own admission there is little they can do due to contracts with bailiffs not being renewed with local authority 🤦🏽‍♀️
Can an individual take matters into their own hands?
I am sure they can’t unfortunately but I would really like to hear why not from a legal point of view

Yes there’s one massive reason. It’s an offence and you’d likely be prosecuted.

Well it is hypothetical because I wouldn’t actually do it but I am so done with child maintenance services being crap and nothing seems to change. I just wanted to know what could I actually do ☹️

What offence is it? Tyre locks are sold on Amazon. I have proof that thousands are owed to me.
I know it is not that simple or legal I just need someone to tell me why - especially when he gets away with not paying for years

No - I’m going to do it. Can’t be prosecuted if I don’t get caught and no way would he support a prosecution if it meant people knowing he doesn’t pay child support.

The offence is immobilising a vehicle - Protection of Freedoms Act 2012 section 54. A prosecution doesn't need his support. Your complaints about how much he owes would make no difference and will only be heard by those attending the hearing. You can be fined thousands of pounds.

Post it on Facebook if you want to tell people he owes you money! Have it as your status on WhatsApp.
There's plenty of ways to declare "I don't get any child maintenance for my children" that don't involve clamping cars

My to sound smug, but my children get £2 a week each whether they need it or not 💁🏻‍♀️Grin
Sorry OP, I fully relate and know your frustration.
It's not right, it's not fair and it's pathetic. The CMS is useless and not going to change.
I block out the fury and say to myself it's cheap at twice the price to be rid of the cretin.

it’s frustrating isn’t it? Normally I am very zen about it all but yesterday being told by a man who is smoking a fag whilst drinking a takeaway coffee that he has booked a holiday with his girlfriend whilst also telling me he can’t afford maintenance just really pissed me off. I just want to find a legal way to make him pay because the CSA aren’t fit for purpose

The money owing is a debt I expect the answer is you can't or everyone would be doing it, but I'm wondering if you can take him to small claims court for the money owed

The council didn’t renew their contract with bailiffs so they have a massive backlog. Plus as long as the other parent bungs £50 every now and then the CSA just let it continue

It’s something like £25-£35 to use the small claims court. They would try to recover the money from him. But tbh if he has bailiffs already on his back then I think your debt would go to the bottom of the list to be recovered.
