Estate/will question

I wondered if there are any solicitors out there that could help. My sibling and I were left a property 2.5 years ago. However the executor of the will (the deceased's solicitor) hasn't passed it over to us as the property has a boundary issue which is being dealt with by the local council but is taking a long time to be resolved. Are we within our rights to ask the executor/solicitor to transfer the property to both of our names so we can tie up the estate as we are currently paying him a large fee each month without much progress really being made and we would like to have more control and liaise with the council directly. A relative also suggested it may even be possible to perhaps sell the property with indemnity insurance to cover the boundary issue although I don't know how feasible this is but if we could atleast take control over from the expensive solicitor that would be a start! Thank you

It sounds as though the executor is a solicitor or other similar person and that the estate has been to left to more than one person (I'm guessing here, you and your siblings)?

The simple answer to both questions is, yes.

If all the beneficiaries were to approach the executor together and make this suggestion then I don't see any reason why this should not be done.

Also, indemnity insurance will definitely help. I would suggest going to the executor and, if they won't transfer the property to the beneficiaries, then suggesting that they just take out indemnity insurance and sell the property.
