Ex threatening to get a replacement V5 on car

Long story short

Car in my name on V5, tax and insurance always in my name and paid for by me.

Relationship broke down, he took the car as he was using it the most anyway (I have another car)

Didn't mind this, until he starts messing me about with the other 5 grand he owes me. He said he wants to sell the car to give me some of the money he owes. I said fine but I will bring the V5 to any interested buyers and they can pay me directly (as i don't trust I'll get the money otherwise)

He's now threatening to request a replacement V5 so that he can sell it himself (and probably pocket the money)

Can he do this? Is there any way to stop him?

Who owns the car? Who bought it, and can they prove it? The V5 shows the registered keeper. You paying the tax and insurance and having your name on the V5 doesn’t necessarily make you the owner of the car.

He can apply for a new V5, and if it’s his car he can sell it. Any money he owes you separately is nothing to do with the car - you need to pursue this as a small claim, which you can do online, if you have evidence of the debt.

I would just demand the car back - sell it yourself .

The registered keeper isn't always proof of ownership either.... A court would say the spouse who used it the most /for the most valid reason like work /school runs...

He can request it but they notify the current registered keeper who has a certain amount of time to object.

Stupidly there was no receipt when the car was bought as it was a straight swap for a previous one, so neither of us have a receipt or anything - i hoped that proof of my payments towards the car (he has none) would help.

I know the car has nothing to do with the money he owes, i just mentioned that because it's the reason I'd like to sell it myself if possible.

There's no point doing a small claim, he has no assets, they can't make him pay

We were on the other end of this. Went to look at a car but the person selling it didn't have any of the paperwork inc V5. We were messed around something awful until we realised she didn't actually own the car - then we exited left!

I have the V5 but no car, he has the car but no V5 - I'm still paying the bloody tax and insurance!

Do you have a spare key for the car? If so, go and take it back and hide it somewhere for now. Get a new key made and then sell it yourself. Even a quick sale through We Buy Any Car or similar.

I think you need to resolve this because if he gets done for speeding or anything it will be coming your way.

I wish he would! If it got impounded at least they'd contact me!

But you seem to be acknowledging that the car is his: “He said he wants to sell the car to give me some of the money he owes.”
If the car belonged to you and you’d originally bought it (or owned the car it was swapped for), him selling it and giving you money wouldn’t be repaying any money owed to you.

If it’s his, he has the right to have it in his possession and the right to sell it.
