Hi
I am looking for advice to see if this is worth pursuing. I started a job in Oct 24 fas an accounts assistant. I had no previous experience in this area as the company were aware. I wasn't given a contract or any proper training. I never received any feedback on my work and wasn't aware I was on a probation period. On 6th dec I was let go for 'making a high level of errors whilst on probation'

I left a company I had worked for, for 11 years and worked my way up to a manager position. Fortunately they have been glad to have me back however I have had to start at a much lower level again!

Is this worth pursuing for unfair dismissal or similar

You need to have worked somewhere for 2 years to be able to claim unfair dismissal, unless there is any form of discrimination and then you would have automatic rights.

Not being give a contract is definitely red flags. But I don’t believe you can claim unfair dismissal for employment under 2 years unfortunately.

There is no requirement to give you a contract, but you should have been given a document setting out the main terms (pay, working hours, etc.). You can find the information that should have been included at What must be included - Written statements - Acas.

After only 2 months in the job you do not have a claim for unfair dismissal. Your only possible claims are for wrongful dismissal (i.e. the dismissal was in breach of your contract by, for example, failing to pay your notice pay) or discrimination.

I'm afraid you have practically zero rights before 2 years service regardless of any of the things you mentioned.
