Council Eviction

Would love to get some advice on this as I'm still none the wiser as to my situation. Been to Shelter and CAB but cant get through. Lost my mother in August, I was her carer and Son. She was a secure tenant. I have it in writing from the council I have a legal right to succeed the tenancy but are refusing to give me the tenancy while I occupy this one, only another property. It's currently under occupied by two bedrooms, it's a three bedroom semi. I understand the council's position and will comply. and as of last week theyve given me the ability to bid on other one bedroom places which I have been doing. However it appears that they will serve me with 'a notice of seeking possession' under grounds 15a (Underoccupancy).

My question is: where do I stand legally should the council seek to evict me from here? The wait times for Category A is over 19 months apparently and the succession letter says i can expect to receive the eviction notice between 6-12 months when they were notified. Will I be offered a suitable alternative accommodation?

You won't have to move until you have been provided with suitable alternative accommodation, and a judge won't grant a possession order against you until that has happened - so the time frames are a bit of a red herring.

It is in the council's interests to fast track you to a one bed and not let you wait 19 months, as they are going to be able to rehouse a family in the three bed, which are far more sought after than one bed accommodation.

So I suppose they would make me an offer of suitable accommodation before seeking possession? My worry is that they will uproot me from my community which I have lived for over 30 years where I am an active volunteer, have my support structure and close to my place of work. Reading the council's housing allocation policy they state that they will make one offer and one offer only before pursuing possession. Assuming the 19 months wait is indeed real does that mean I will have to take whatever they offer?

You might not have a choice though on where they house you.
