My ex partner is taking me to court for custody. Our LO is now 10 months old and hasn’t seen him once except for at the birth and he insisted they did skin to skin. After we left the hospital he didn’t even ask how he was despite our LO was very early and had a feeding tube in the times he had seen him. He has been demanding a dna test since he was born even though they look identical!! He has been making my life so hard like ringing social services for me taking him into a pub in the afternoon for some lunch to introduce him to my friends for the first time. It’s ridiculous. But now he’s taking me to court for custody. He was supposed to have had the dna test before the first hearing but he hasn’t done that and hasn’t even paid for one because he knows he doesn’t need one!! I’ve said to him multiple times he can have one but he clealey thought the court would fund for a dna test but they have told him to go through CMS. Any normal person if they genuinely thought thr baby wasn’t theres would surely do the dna test first. Not go and get a solicitor and go through court. He has completely ignored the fact he’s got a baby and never provided one thing. He’s told everybody that he’s not his baby and everybody thinks he’s stupid as they look the exact same. He’s also told so many lies about me to be able to get legal aid when he was the abuser in the relationship. Does anybody know what to expect in court? I’ve got an awful solicitor that doesn’t communicate and doesn’t answer my emails and the hearing is on Tuesday.

Presumably you've already set out in your paperwork what you want the outcome to be? The first hearing is to agree what needs to be done - what reports will be ordered, does the child need a guardian, what the interim contact arrangements are. Then they'll set a date for another hearing to review all the reports etc and hopefully make a decision.

I would start by emphasizing that on the one hand he's not involved with your child and disputing paternity at the same time as he's asking for residence.

I would also ask for a direction that he undertakes a DNA test

You don't dispute that he's the father, he's attempting custody which implies he has accepted he is the father - so no need for a DNA test.

@titchy i received a call from CMS 2 days ago saying that he has told them he’s not the dad. He’s basically just gone way too far with the dna test excuse as he thought it was going to get funded by the court but now he is being asked to pay £324 which he won’t want to do as he knows he’s the dad but he can’t say he doesn’t need it know as he’s saying that’s the reason he’s not been present in our babies life.
