Can I go through court from another country?

I have got myself into a situation. I have to move back to my country of birth in the next month permanently. But I need to take my name of the title of the house and mortgage of the house I own with my ex and go through family court while being in another country?

Yes. If you have to actually go to court you'll obviously need to appear. Instruct a solicitor if needed in the country where the house is.

It depends on the issue at hand and the countries involved.

of the issue is child custody and it is a Hague convention country, you can’t just take shared children and leave. Your ex can seek court intervention.

Is there SS intervention, or would you be putting the child at risk of harm by being around them? If not I would think really carefully before doing this, OP!

@Hekett It’s such a strange situation. It’s actually an adopted child. My ex was amazing with the child and partly due to the child’s past and my ex wanting to do all the parenting I didn’t really bond with the child. After my ex and I split the child didn’t want to see me. I wanted to be removed from the paperwork to make life easier for them. But I found out I am pregnant and want to move to my home country so I can actually parent this child without my ex interfering. So I don’t have time to go through the legal process, and I don’t want my ex to know about the baby just yet. But the child left with him will be very well cared for.

Before you make any moves, you really should see a solicitor specializing in international custody if the baby belongs to your ex.

He doesn’t know about the baby. I want to move and have the baby before I tell him.
