Question regards to dog escaping into our neighbour’s garden. My neighbour’s side of fence is a tall pivot hedge but our not so small dog keeps finding gaps to escape and dirt into their garden. We have tried to block every visible gaps but somehow he still manages.
Am i correct in thinking that even though it’s legally his responsibility to fix it if it was broken, it is my responsibility to purchase a more suited one if i can’t stop my dog from going through?

Well, this is a weird way to start the morning - lots of perfectly correct and normal responses, and the OP being bizarre about them!

You need to keep your dog contained, and you need to not damage your neighbours property while doing so. Likely you'll need to put up your own fence on your property (while your neighbour maintains the boundary with the hedge)

This thread is bizarre. You asked a question and people calmly replied with the factual answer. You then accuse everyone of bullying and being emotionally unstable, Have some replies disappeared or are you just angry that the replies didn't tell you that your neighbour is responsible for putting up a proper fence as they're responsible for the boundary?

Although it might be your neighbour's responsibility to maintain the boundary it is not their responsibility to provide a boundary that will contain your dog. That's your responsibility.

It's your dog, trying to claim it's someone else's legal responsibility is pretty low tbh

Just be glad it's not into open farmland and a trigger happy farmer eh

To maintain a boundary only requires on piece of string or wire between two points. It does not mean a barrier. As you need to legally contain your animal (whether its a dog, chickens or goat) you need to create that barrier within your boundary line.

BTW many men post here too so I don't understand why you are attacking women posters, how do you know they aren't men?

You asked a stupid (not simple) question, and got obvious answers - nothing that anyone wouldn't have said in reality. The majority of your post is irrelevant. The stupid question was "Whose responsibility is it to make sure my dog can't escape?". The obvious answers are "Yours". To be fair, in reality I would have said "Yours....(mutters under breath) bloody idiot" but I would never say that on a no face platform.

The law meanwhile is unclear -

"There are no laws regarding the trespass of dogs. If a dog of its own accord enters land without permission but does no more, the owner is not liable under civil law for the trespass; nor is it a criminal offence.
If the dog causes any damage whilst trespassing, the law is not clear but it is possible that the dog’s owner will be held liable for any damage caused.
If a dog bothers you by regularly straying into your land"...goes onto say get advice from the council
I think though common sense would say that it's hard to pin any crime on the dog or owner, I do know that it's not an owners responsibility when cats stray onto your land,
But having said that I'd find it super annoying & if any damage is caused you can hold owner responsible

Whilst there are no laws regarding dogs trespassing, an owner can be prosecuted if their dog is dangerously out of control anywhere, including a neighbour's garden. A dog can be classed as dangerously out of control if it injures someone, makes someone worried that it might injure them, attacks someone else's animal or makes the owner of an animal think they could be injured if they try to stop your dog attacking their animal.
