LPA/Will

Someone medical has told me that as we do not have LPA for DM it may be in her will that she gives consent for next of kin to act if she lacks capacity. She does lack capacity (dementia) and she is very ill.
Does anyone know how this will be worded or what it's called? Unfortunately the person is now on leave so I can't ask.

I don't think that's right. A will is a document that specifies how someone's money, property and possessions should be distributed after they die. It doesn't come into operation until after the death.

Have you seen a copy of the will?

I haven't seen her will.

My understanding was LPA was for someone alive but lacking capacity and a Will was when they had died. I thought a will only became 'active' after death.

I've had no joy connecting the solicitor either.

Yes that is my understanding too.

A lot of offices are closed over the xmas/new year period. You may have better luck contacting the solicitor next week.

They are talking bollocks. LPA pre death and Will post death.

Thank you for your help folks, sadly it will be too late to get deputyship or even get hold on the solicitor.
