Injury claim car insurance

I was in a car accident in the summer. It was the other drivers fault. It’s been 6 months and I’ve been told that I can make an injury claim for whiplash. I have visited my GP since the accident and they agreed that my muscles were tensed and put me forward for physio. I also seem to have worsening knee pain.

In that time I’ve moved homes and it’s been stressful - the 3rd party insurance has accepted liability but have said that they do not want to take responsibility for my injuries as I would have pursued these earlier. I’ve only just had the brain space to take this on.

I want to know if anyone has tried to claim alone or if you would recommend going through a 3rd party (the law firm attached to my insurance will take 20%). Or if it’s best to always use a 3rd party in these scenarios.

I haven't claimed personally, but I do work in personal injury and the split for my caseload is roughly 50/50 between represented and unrepresented claimants. You can submit the claim yourself via the official injury claims portal online.

I'm sorry that the TP insurer is trying to fob you off. You have 3 years post-accident to submit a personal injury claim, so don't let them put you off. I can't really comment on whether it's best for you to get representation or not. As it's mainly a whiplash injury you would be subject to the government's whiplash tariff, with perhaps a separate amount for your knee injury, so realistically the award is likely to be fairly low. It's worth weighing up the economics I think.
