Not Paid Salary Due

My son worked for a restaurant in our city for a couple of months from 22nd August this year. He got his first payslip on the 4th October which to me was late, he didn't get paid until the 11th October and only after much chasing ! At this point we realised this was not a good company to work for and suggested he find another position - which he did.
His second payslip arrived on the 4th November for the additional hours he worked (approx £700 take home pay). At the time of writing he has still not been paid!
He has chased up his manager and was fobbed off with lots of different excuses and promises that it would be sorted. He can now not get hold of his manager and we suspect she has left the company too.
He has been in touch with Acas but to be honest they seem a little slow at acting and I do suspect this restaurant will be closed after Christmas.

Any advice anyone can give us would be much appreciated :)

Has he actually been in and spoken to the manager?

Report then to HMRC for paying less than minimum wage?

He may not get anywhere with this. He can take action in the employment tribunal to recover his wages. However, if the restaurant ceases to exist, that will be pointless.

S13 of the employment rights act, if I remember correctly. If they go bust he can claim as a debtor, but they're usually last to get paid.

I would go into the restaurant on a busy night and demand the money. I'd tell them I am going to contact HMRC and put a claim into ACAS. Otherwise fill out and submit the necessary forms with acas for non-payment of wages...now (don't wait).
