upskyy · 28/11/2024 16:27

Husband has received a letter from a solicitors saying they have been instructed to recover 5k.
This is related to an apparent car incident last year.
Husband says there was no contact with her car, didn't need insurance etc moved on . Letter says their client has incurred costs due to going third party.

What do we need to do/respond to this please?!

Refer it to your insurer which should have happened in the first place by the other party.

Lyannaa · 28/11/2024 16:30

This happened to someone I know. It was resolved when he contacted his own insurance company.

Reach out to his insurer, and maybe double check there isn't more to it than you have been told

LittleRedRidingHoody · 28/11/2024 16:32

Yep. Go through insurance.

If he knows of the incident, he should have flagged with insurance in the first place - an expensive mistake to make 😬

Op says 'no contact with the car' what would you say to insurers? Didn't have an accident, noone was hit?

Bannedontherun · 28/11/2024 16:38

@DoreenonTill8

Quite, Thats why the claimant should have at bare minimum took a photo of number plate, and notified their own insurance (if they had one)

CrazyAndSagittarius · 28/11/2024 16:41

If there was no contact with her car, what is she claiming for?

Ridiculous comment. Husband said he was aware and there was no contact. Cannot bear people who enjoy twisting the knife.

You know nothing.

Why don’t you tell us, you seem to think you know everything regardless. A bit of a pointless venture to keep commenting if you believe strongly enough to comment it that the OP won’t be back to answer, don’t you think? 🙄

Call your insurance, they'd be the ones paying out and they always say can them before admitting or agreeing anything.

DemonicCaveMaggot · 28/11/2024 17:13

Refer it to your insurer with the information that there was no contact with the car.

It could be someone trying it on to get money out of you. They should have claimed immediately after the accident.

Also, some 'solicitors' are actually debt collection companies and some of them have very dodgy ethics. They can have a parent company registered with the Law Society so they look legitimate but the subsidiary is very different from what I would call a solicitor.

Yes, we’re all aware that you don’t actually know anything but you’ve made the point twice about your “suspicions” of there being more to it and then stated “likely” the OP won’t be back. Suspicions based on lack of evidence often point to a person being rather paranoid. Either that or as another poster suggested you’re just unpleasant and trying to place unfounded doubt in an already upset and stressed OP mind that her husband must be lying.

The contents of the letter could have just jogged his memory about the incident in question where he had a near miss but didn’t actually make contact with her car.

OP I think what is more than a bit suspicious is that she’s taken a year to try and make a claim instead of going through her insurance at the time. She should have reported it within 48 hours to insurers otherwise her policy could be cancelled and her insurance voided which is an incredibly foolish and expensive mistake to make. As she hasn’t followed standard process I can’t exactly imagine she would get very far trying to drag this through court. A solicitor will write whatever you ask them to if you pay them enough but I would consult legal advice as a precaution.

Did I say you’re not allowed? Don’t think I said that anywhere. I’ve just not tediously and repetitively commented the same thing. The fact she didn’t go through her insurance at the time but has come back so long after the event to try and sue is suspicious behaviour. You have nothing from the information given to suggest that he’s lying or that she won’t come back only about half an hour after writing her post. You may have a lack lustre life and time to continually post on this thread multiple times over but the OP is clearly busy.
