Conviction and enhanced DBS

I know the rules have changed on this and I’ve been googling but honestly it’s as clear as mud.

I have a conviction; a ‘minor’ one (no fraud or sexual or violent misconduct or anything like that.) It was a driving offence.

I received this five years ago.

I believe under new (ish) rules i will not have to declare it after a certain date but does anybody know or can make sense of the government website to tell me when this is? It’s really confusing.

Unless it's a driving job will it count? Ds had some minor offences as a teen. Nothing violent.. He was still accepted into the army. At their discretion apparently...

The DBS form? I haven’t filled one in for a few years now but I am wondering if I did apply for a new job what needs to be declared.

@Stormyweatheroutthere - this is the thing isn’t it ‘their discretion.’ I got my current job no problem but I’d prefer not to disclose it if I don’t have to, because I know it will put some employers off.

I don’t need to say the conviction @saucestoke . I honestly don’t want to sound like a dick here but you don’t know, you want to know what I did! So it’s unlikely to be helpful in that respect.

I'd really hope the law hasn't changed on this.

Everything has to be disclosed on your past history.
Spent or unspent.

I have a traffic conviction from over 5 years ago (not one of the list above!). In my current job I declared it on both my DBS and SC applications - on the basis I'd rather 'overdeclare' than risk not declaring something. If it is 'spent', declaring it will cost you nothing.

I do know what you mean and this is why I want to know beyond any shadow of a doubt before I don’t declare it. It’s all very well and good to say it won’t make a difference but it does; people do judge and if it comes to you and a similar candidate but they don’t have a conviction it’s understandable they might plump for them, which is possibly why the law changed.

So I've been off to Google.

Apparently they can ask you if you've got any spent conviction under the "something act "

So no-one can really answer your question.

I would declare it. If you don't and it comes up you will have shown yourself to be lacking in integrity and honesty.

Is it a relevant offence to the job? if it's a one-off, spent, and any points on your licence have expired then it shouldn't be held against you if you declare it in a spirit of openness and honesty.

But it also depends what you mean by driving offence, I remember an applicant quite a few years ago now being a bit vague about a "driving offence" - and when we checked it was a possession offence as a result of a traffic stop. I don't think they apply that as an endorsement now, but at the time they did because we identified it from the driving licence.

I think we’re all posting at cross purposes. The law definitely changed re what comes up on enhanced DBS. I know my offence will be removed; what I am trying to find out is why when

It's a job with EDBS?

I renewed my EDBS a couple of months ago (voluntary position, not an employed job) and I have never been asked by the organisation I renewed through for details of any convictions. I was given that section of the EDBS to complete online without them looking - they passed the laptop over and went to get a coffee. They are only informed whether you pass/fail the overall assessment relevant to the position they are putting you forward for the EDBS. So over-declaring wouldn't have been an issue.
