Can 35 year old videos of children be monetized for fundraising.

Well they're probably still the property of the school. I'm the age where my nativity videos are that old lol did our parents sign releases the same way we do now?

I may use them to fund our allotment. No they are my videos. I spent two years making a few videos for local schools and sold video tapes for £5. No written agreement was ever made. I always initiated these projects to schools and I'm aware that every child matters and would never release them without permission. I intend producing very short clips to show their child with the parents permission.

If you made the videos there are no copyright issues. The only possible issue I can see is around GDPR. If there is a recognisable image of someone in the video, you probably need their consent to sell it. As this was 35 years ago, parental consent at the time is no longer relevant. The children are now adults, so you need their consent.

Having said that, I doubt you will have any problems if you proceed without getting their specific consent. It is unlikely anyone would be bothered and, even if they are, you may have justification under legitimate interests on the basis that selling these videos is in the interests of fund raising and that the impact on privacy is minimal.
