Directions hearing order from barrister

Notsureaboutthisbit · 22/10/2024 21:27

Can anyone help clarify for me please

If a barrister for the applicant drafts the order as directed by the Judge, and it contains Information which is misleading or worded badly, can I ask for it to be changed? It is to be sent to the local authority and I am worried it will trigger another safeguarding issue...

Any advice is welcome. Thanks all.

It is the court’s order which is just typed up by the barrister on the judges behalf. It would have been reviewed and approved by the judge prior to sealing so the wording will have been approved by them, therefore I do not believe you have grounds to vary this.

If the order has been drafted by the other side’s barrister, then you (or your legal representative) usually is sent the draft to confirm it reflects your understanding as well. At that point you can suggest amends and refer back to the judge if a point is in dispute/for approval of the order. Does that make sense?

If the other party is a litigant in person it usually is not sent to them in draft.
