Hi, I’m new here today and just wondered, do I need a separate solicitor from my husband? We are selling our property and separating, once the mortgage, estate agents fee and solicitor fees are paid, the remaining is being split in half. As it’s an amicable split, do I need my own solicitor? Many thanks.

It depends is it a conveyancing solicitor who is simply selling the property and therefore acting for both of you in the sale?

Absolutely I'd recommend you have your own legal representation during the divorce. What's happening with the other marital assets? Both your pensions and savings?

Yes. No solicitor can act for both of you as they must act in their client's best interests. Someone can't do that while helping both of you. Find a recommended firm.

It is just the conveyance solicitor to sell the property. I will be purchasing my own property and he doesn’t know what he’s doing yet. The profit from our property is being halved and going our separate ways.

Your new property (or everything you now have, even years later). You need a financial settlement So everything is sorted legally whether via a solicitor or otherwise.

You need a clean break financial settlement. Everything goes in, savings, investments, pensions, house etc. Then it gets divided up and seen by a Judge who will make sure it is fair and if so, it will get signed off. Should you win the lottery the day after, your ex will have no claim. This is the most important part of the proceedings, and is best done between Nisi and Absolute.
