Consumer rights question faulty new car

Hi all,

Bought a car with £5000 deposit (£1000 on credit card) and remaining on hire purchase.

Within 3 weeks it was back to the dealer with an airbag fault, now 6 weeks later it’s got an engine fault amongst many others. Can’t drive it.

I’ve asked the finance company to reject the car for a refund.

They’ve said as this fault is different from the first they have a right to repair but I thought it was if any other fault appears within the first 6 months? It’s 2 months old with 2000 miles on it!

I’m awaiting their decision on it if they say no considering financial ombudsman or section 75?

Aside from that I’ve been told not to drive the car, can’t get it to a dealer until the 30th September and the manufacturer, dealer, finance company or breakdown company can’t provide a hire car. The manufacturer only will if the dealer confirms the fix is covered by warranty!

I had the opposite - Renault supported me in the rejection, the finance company refused. I was without the car for 5 months initially, then 3 more times of 2 weeks - a month. It was a shambles, the finance company lied, didn’t provide supporting evidence and didn’t respond to emails.

Didn’t Renault give you a courtesy or hire car if it was under warranty?

Thankfully as mine is being “repaired” under warranty we’ve at least got the hire car until mine is back on the road. But it was a brand new car… so maybe that’s why.

If we didn’t I’d have had to buy something by now as I have 3 young kids and we were missing out on booked classes and activities not having a car to get us places!

Have resigned myself to it being a long road ahead but at least we have the hire car! Hopefully credit card company come good before ombudsman get involved but might take it then out of principle given how the finance company are acting!

What a shame op, that must be really stressful and upsetting after the excitement of a brand new car. I think you need to stand your ground and be really annoying to the dealer so they support you in sorting out a new one.

Yes I had hire/courtesy cars each time but that wasn’t straightforward … first hire car broke down itself after 2 weeks, next one was ok but Enterprise tried to charge me for tyre damage weeks later after they had accepted the car back and refunded me the deposit (they backed down eventually), after that I refused to deal with Enterprise and refused to leave the dealership without one of their cars, they gave in eventually. It was an awful time, without the ombudsman I honestly don’t know what I would have done, finance company tried to tell me that the car wasn’t faulty enough to reject but also paradoxically too faulty for me to just return and end my contract. They’ve sold it on now, I feel so sorry for whoever has it!

I wonder how much is faulty “enough” not that that comes into consumer rights at all.

I find it shocking that the finance companies can act unlawfully but don’t get fined for doing so the remedies of the ombudsman are small amounts of compensation and possibly some interest on the monies. Crazy!

Enterprise have been ok with me but will be spending over £2k with them so no surprise! Hope they don’t try anything funny!

What annoyed me was that they didn’t send the documents my case worker asked for, there was no penalty at all for that and meant it had to be escalated so took even longer to get resolved. There is no obligation on their part to provide the information requested.

Yes, you lied.

While age of the car is indeed relevant, so is the brand.

If it had been a Volvo or other German car, I could understand why it broke down because usually, they are completely overpriced pieces of shit.

A Kia? Not so much akin to those other cars as they have usually have very good / better reliability ratings. Ergo, in such an instance, you'd have a better outcome for something not expected vis a vis a Volvo etc.

But yeh, you lied. Dress it up whichever way you like but that is the fact.

Are you joking? They’re no better than average these days and in many cases well below! They made quality cars 30 years ago and somehow manage to trade on that reputation, the joys of marketing! Japanese cars have been the most reliable for many years now, with the exception of Nissan since the involvement of Renault.

Btw what was wrong with the car? That’s a crazy amount of time for faults.
and can you say who the finance company where, mine generally send me replies to emails even if they’re snotty and unlawful.

Electrical error warnings, they said the traction battery but different people told me different things about what repairs they had done so I don’t even know what got replaced each time. It won’t be the same finance company as mine was the Renault one.

Middle of the road is meaningless - Volvo is an inferior car maker compared to Lexus/Honda/Toyota. End of discussion.

Anyone buying a China owned Volvo deserves little sympathy.

What is your problem here? Either try helping the OP or get lost
