Do I have a case against the council?

I am looking for a lawyer who deals with council queries.

A little back story: 1 year of antisocial behaviour. Council didn't move us in time. The guy set our flat on fire deliberately and tried to kill us while we slept. Sadly someone passed away. The guy has been charged with arson with the potential to cause injury and manslaughter.

I would like to take the council to court for negligence, physical and mental trauma.

Ps. We escaped by jumping from 2nd floor flat, threw my then 3 and 4 year old children out of the window. We also lost everything.

I think I would raise complaints all the way through to the end and then if no decent outcome I'd be considering suing if they've been negligent

Would it not be the police rather than the council? Had you reported threats and previous criminal acts to them? What action did they take?

i am so so sorry as this is horrifically traumatic .
even if the council have funding problems and no emergency accommodation available I think a year is too long to have not prioritised a move given the threat so it seems worth getting advice. I really hope you get support and safety as must he hard to recover

I've raised stage 1 complaint. They should reply within 10 days. They rang me on the 10th day saying they needed more time as investigations were being carried out.

Ps. This was last week and the trial finished this week. So I think they were waiting for the verdict :/

It won't be a police matter as the antisocial behaviour has been going on for 1 year. We've called police on them more than 20 times. The guy who committed the crime is well known to the police. When we first went running to council because we feared our lives, they turn us away. Really appalling treatment.

Yes, because he's well known to the police. Has been barred from everywhere in where we live.

Thank you, really appreciate it. I think it's a lame excuse really because to them our lives meant nothing.

In their own words, they told me if this was a few years ago, we would have moved you right away but we've got housing shortage.

I wasn't working at the time, my husband was self-employed. I was a student so couldn't afford private renting :/

How about these fucking housing associations and councils take some fucking responsibility for who they allocate homes to Get a load of this,

I want compensation. We've lost everything. The flat has completely burnt.

Not only financial loss, I don't think anyone could comprehend the mental trauma we are going through now. Just imagine, if I had slept 2 more minutes, we wouldn't be here today. I woke up by accident. This incident happened around 3am. The guy put a wheeley bin to block our door so we won't make it out alive and lit the bin on fire :(

The sad thing is, they knew families and elderly people lived in these flats, yet they placed dangerous people like this there. Really disappointing.

Omg I'm so sorry that this is happening to you. Make sure you daily logs of the ASB. Contact your councillor and MP. Don't give up because you don't want to end up like us.

This makes me laugh. Seriously? Someone says this every time there’s a post about a civil case. This is literally the very definition of loss and trauma.

Oh my word, that is beyond horrific. I’m so sorry for what you have gone through.

I do hope you get somewhere with the council. They surely have a duty to keep their tenants safe and in this case, as there had been previous incidents they knew the risk was there although they will say they may not have been able to predict a fire specifically!
