Hi, my husband has received a phone call from the CSA and they have given him an amount to pay based on his last years p60. The problem is he said he won’t pay the amount as he thinks it’s too much. He has a very well paid banking job and says he doesn’t think he shd pay this amount and shd be based on his basic salary. He earns amazing bonus which is paid once a year. This year he has said it will be even more. My question is can he refuse the CSA request or can they take this taxable bonus into acc. He thinks the month he earnt his bonus shd be discounted. Thank you

Yes they take his bonus into account, if he refuses to pay they can take it directly from his wage.

As above all paid income is used to calculate CMS. And they can pursue the funds directly if he chooses not to pay the agreed amount.

My ex has not long requested a reconsideration after our Annual Review which left him paying nearly twice as much because of his bonus. It came back with no changes and his only option is to take CMS to court if he doesn't agree.

Why doesn't he went more of his money to be used for his children? Sounds like he earns enough to do so.

Isn’t child maintenance capped at earning £156k per year unless you have a separate arrangement through court? I’d assume an ‘amazing bonus’ takes his earning well above this?

how much does he think he has to pay?

And they'll charge an extra 20% on top in fees. Personally hope this happens. What sort of arsehole wants to deprive his children and begrudges paying the minimum LEGAL REQUIREMENT. Your husband sounds like a prick

Ah, so you're the receiving parent? It will include his bonus and if he doesn't pay it they will (eventually) take it at source.

OP your husband can refuse to pay CMS. I very much doubt he will be forced to pay it.

Of course he will have to pay it if he's employed. They take it straight from his wages (if you nag them enough)

Why do you think the CMS won't force him to pay? They have the powers to enforce payment and they are increasingly using those powers.
