Ex refusing to pay parking fine

My son is going through a very acrimonious divorce. When he first separated from his wife he let her keep the family car although it was in his name and he paid for it. She taxes and insures the car but he is the registered keeper. She has received a parking ticket which she is refusing to pay . As he is the registered keeper it seems he is liable although he can prove it was not him driving the car . Can he now declare the car off road although he knows she is driving it? He might end up paying this fine but he doesn't want her racking up more fines that he would be liable for as the registered keeper. Tia

He needs to send a recorded delivery letter to the parking company stating who was driving and their full address.

Presumably she transports his children on the car so no he should not be declaring it off road. She should pay the fine though.

Normally the registered keeper should respond stating who was driving it. If he has evidence to show it was not him (google maps is quite helpful here as it can often show your history if you've had that turned on) he should provide it

Thanks both. He has full custody of his child and his ex cannot have unsupervised access so she doesnt need to drive their daughter. He has written to the company that issued the fine and can prove he was not driving the car himself but is still waiting for a response.

It sounds like she parked on private land, in which case trying to convince the company that his ex was driving will not help. Under the Protection of Freedoms Act 2012, the parking company has the right to recover unpaid parking charges from the registered keeper. However, he can take action against his ex in the small claims court to recover the fine from her.

The simplest thing for him to do would be to make her the registered keeper. That way she would be liable for any fines.
