Part of order delivered and assembled - refund

We are in England. I ordered a nursery furniture set 9 weeks ago with the promise of it being here in 10 days. Two whole weeks after I placed my order, I receive an email from the company to say that the cot is out of stock, will be delivered within 3 weeks, but would I like the other elements delivered in the interim.

I agree that we would get the other items delivered and wait for the cot. They promised it would be within a few days, however it took a lot of chasing and an additional 2 weeks before the items arrived. So 4 weeks total.

We are now 9 weeks in from order, still no cot, baby about to make an appearance. The other furniture has been unpackaged and hours have been spent putting it altogether.

The company's attitude is absolutely disgusting. They just say they are trying to organize delivery with their suppliers and that's it.

At this point, I need somewhere for my baby to sleep. The order was not individually priced so I can't ask for a refund just for the cot, and in any case, it's a set so wouldn't work with another cot.

I have now threatened that I'll get my CC company to refund if cot isn't delivered this week and that they'll have to collect the other items at their expense, and as they are, because I am not willing to waste hours more disassembling and repackaging etc I don't even think we have the original packaging anymore.

My question is, what would the law's stance be on this? We've honestly got such little time now until baby gets here and the assembly of what was delivered really did take hours of our time. Will we be seen as at fault if we refuse to spend hours more taking it all apart?

I'm heavily pregnant and exhausted and stressed at this point as there's nowhere for my baby to sleep. Any advice welcome.

Baby shouldn't be in a cot for a few months yet. Cits aren't that difficult to assemble either. Keep nagging, the cot will arrive.

Get a Moses basket. Baby doesn’t need to go into a cot as newborn. Look for 2nd had one and just buy a new mattress. Easily be around £20

You’ve got months until you will need the cot. So, if you really want this style then give them longer. Use the resolver website; it’s brilliant.

I’m assuming you have a Moses basket for in your room? Because it sounds like you’re building all the furniture (and the cot) in baby’s own room. The baby shouldn’t be sleeping in their own room for several months yet. You know that, right?

I really don't want to sound rude, but I find it very frustrating when people respond with comments that are nothing to do with my question. This is not my first baby, I know where and how they sleep.

I've posted in legal with a very specific question and returns and refunds for an order that is 9 weeks late with no delivery date in sight. If anyone can answer that specific query, I would be really grateful.

You’re the one who made the point that there is no where for your baby to sleep. Your baby wouldn’t be in the cot for months anyway so that really isn’t a consideration at this stage.

If you want the set then wait; give them a bit longer. If you’ve decided you don’t want to wait for them (which is fair) then you are entitled to a refund. They have to deliver the goods within 30 days (or a longer date if that’s been agreed). They haven’t. So, you can have a refund. You do need to return the other stuff though, unless you and the company can agree on a partial refund to cover the cost of the cot.

I am well aware of that. Are you aware of how many people refer to a set when they have ordered a number of separate matching items from the same source? My question therefore stands - was this ordered as a single item containing multiple pieces of furniture or individual matching items.

All one set. No option to purchase items individually either.

Thanks. My biggest concern is that it's all already been put together at great time and effort and the packaging was long discarded. Therefore I wondered if we could insist they collect the items as they are and not spend more of our time attempting to dismantle.

Bad mother here - three babies who all slept in a cot from their first night, never had a moses basket or anywhere else for them to sleep. And as the OP said, this is not what she asked!

It's like buying a kitchen - it's all delivered except for the larder unit / sink / cupboard handles - can you reject the entire kitchen because they keep fobbing you off about the delivery of the one specific essential element you are waiting for?

Write to the retailer (email will do) giving them a deadline to deliver. Include the words, "Failure to deliver within a reasonable time and after the agreed deadline is a breach under the Consumer Rights Act 2015. Time is essential. Please deliver the item without undue delay." If they don't deliver by the deadline you set, you will be entitled to a full refund.

You can make something called a s75 claim with your credit card company.

Goods must cost £100-£30000 and can claim within 6 months if company doesn't deliver what they promise
