Rent arrers (I'm landlord)

our tenant stopped paying rent and communicating with us at the beginning of the year. we have tried to communicate to sort it out to no response.
we are using a company to navigate the eviction process and it is proceeding to court after they didn't leave when their section 8 said they should

the only evidence they have asked for to take to court is bank statement/rent statement of payments that have been paid.
they obviously have the contract and dps form etc

is there anything else I can send them such as late rent letters. emails/texts where he says he can afford and will pay soon etc

had anyone else been in this postion and found they did leave when the court said or did you then have to get the bailiffs involved?

Rather than go to court we offered to waive the overdue rent and not go to court to our tenant if she left by a certain date. She accepted the offer and walked away with no CCJ.

The money we lost (about 6 months rent) wasn't very different from going to court, after which she still might not have left anyway.

Mumsnet is very anti landlord OP, you'll have people on here telling you you're super fortunate and should give your tenants the house for free because they're clearly having a hard time soon.

Do you know what situation they're in or why not paying? If hankering for council house they have to stay until they get court eviction or be classed as intentionally homeless.

we were willing to break the contract and walk away loosing money but he stopped communicating completely. so can't offer anymore deals.
he communicated with the eviction specialist at the beginning and we had a part payment plan set up. nothing came and won't speak to them either.

he had his own successful business when he moved in and hasn't given us any reasons for no longer paying except il pay you next week. I'm on holiday will pay when back etc then nothing

I think a lot of people don’t understand we are not all wealthy landlords.
I worked 7 days a week to renovate 2 flats for my retirement.
if we all stopped paying rent where would we be!
our tenant was in prison unknown to us, took months to sort things out meanwhile we suffered with a poor income and a flat which required total renovation

Our tenants did a moonlight flir literally disappearing in the middle of the night this was after we'd started court proceedings. Our lovely neighbours rang us because they were so worried they'd left without a word. We were just thrilled they'd vacated the property.

We were fortunate that we were able to track down their guarantor (who had also attempted a disappearing act) and got our rent arrears (and court costs) paid back. To be honest, them leaving was the best outcome possible. We just wanted our house back. (And fir us it was our house as we were living abroad for a while)

Is it possible they need council housing? Some councils won't help until you're actually evicted and can say you're homeless

it's appalling for everyone but many are doing this

The council won't help as they've made themselves intentionally homeless.

OP. If you're paying a compnay to process the eviction don't do anything outside of what they instruct as you could be opening yourself up to harassment or other issues.

I suspect thet will stay put until they are actually evicted as that is what the councils usually advise people to do.

If they don't then they won't be eligible for council housing.

Ridiculous waste of money and court time.

Hi everyone. the court saw in our favour and issued him to leave at a certain date and pay arrers.
He didn't leave and we are waiting for the bailiffs to set a date
All our savings are gone (we're both self employed) this was meant to be a retirement pot and the flat like a pension

it's so sad and I dread to think what state thr flat is in

He could be looking for council house but he is a young professional with a good (on paper) company and gave no reason as to why he stopped paying

@ConfessionsOfAMumDramaQueen , we’re on our second tenant who is forcing us to evict so that they will get council accommodation. I don’t expect any sympathy on Mumsnet. It’s expensive and stressful and people know how to play the system, they’ve both been quite upfront about their motives. 😡
