Final hearing help

HappyOpalMember · 11/08/2024 21:09

I have a final hearing in less than 2 weeks. The father has alienated me from the children and refusing to allow any other access other than at a contact center. He has a lot of money and representation. I don’t get paid until the day of my hearing but desperately need representation. Does anyone know if this is possible to obtain?

Could you try a McKenzie friend? Google them there's loads & there will be an official website membership organisation I imagine. Check it out.

Or law society might also provide a barrister but you'll have to act fast if you want to get someone pro bono

HappyOpalMember · 11/08/2024 23:20

Thankyou very much. How do I get in touch with the law society to see if they can provide one pro bono? Or can I get one to agree payment actually on the day of the hearing?

Have you had any cafcass involvement?
A guardian appointed?
Section 7? Section 37?

Have they made any recommendations?
Have your children spoke to anyone?

Judges usually go with Cafcass recommendations 75/80% of the time - so if the reports went in favour of you then it would be less important to have representation.

Could you put it on a credit card (if you have one)

This would be a good place to start, you can apply for a barrister I think here. Although you might have to ask to delay the hearing in order to secure legal representation.
Check your insurance policies they may include legal help you don't know about.

Contact centre is the last resort when it comes to contact. In what ways will your ex say you are incapable of having the dc alone? You can counter that yourself without representation if you have no money.

DoreenonTill8 · 12/08/2024 08:54

How old are the dc and are they living with him as RP? How much contact are you having? As @RedHelenB has put above a contact centre is usually last resort, what's happened?

HappyOpalMember · 12/08/2024 09:57

We have both, Cafcass have gone with me, but the section 37 fell for his Mr nice guy act totally. However I have been told that this can often be the case as the section 37 is done by local authority and they’re less familiar with how parental alienation can happen.
Both are testifying at the hearing.

Yes they are living with him at the moment, he took them and moved without telling me where they were. He’s bullied and intimidated me, accused me of serious ongoing mental health issues when I struggled to cope with the loss of my kids when he took them! I have evidence of all of this. He’s basically slandered me to everyone and then I’ve proven all his claims wrong but he continues to do this and he’s so manipulative his managed to convince people. This only changes when people actually meet me and realize.
He’s trying to confine me to a contact center so he can keep control, a contact center was the only way we could get an agreement from him to let me see them again. Since then he has refused to move from this. The judge is the only one who can force him to stop all this. So I really need to be able to make the Judge aware of what has happened.

No judge would order contact centre only without good reason. Who agreed to this before a court judgement? Who is “we”? What evidence led to the contact centre agreement? Judges don’t always follow CAfcass. What is LA saying? The fact these are involved means it’s not straightforward.

House insurance will never cover this! I’ve no idea why people say it. Ask Stowe Family law. - specialists in this type of case. Do you qualify for legal aid? Someone might take it pro bono. Or get the case delayed so you can get representation.

JoanMacIntosh · 13/08/2024 09:26

Are you not eligible for legal aid? Or represent yourself?
