I inherited a flat from my great aunt and have just sold it. The FTB that bought it wanted most of the furniture and as I already have a house and don’t need it I agreed to leave most things. Most of the furniture is 15 plus years old but my aunt had amazing taste and didn’t stint on quality.
One of the things left was a sofa bed, probably @10 years old and I’ve never used it.
The FTB are now requesting £1500 as the sofa bed mechanism doesn’t work so won’t pull out. They are pissed!
At first they text me wanting money and when I said that the sofa wasn’t integral and wasn’t paid for so I wasn’t going to buy them a new sofa they have gone to the small claims court.
I have spoken with my solicitor and he said that they never asked for the condition of the sofa and didn’t pay money for the sofa so they don’t have a leg to stand in but do they? Would the courts side with them?
I have no receipts for the furniture and didn’t even know about the bed not working.
Anyone experienced anything like this?

I wish I could take away your nervousness away from you. I know you can’t help it, but you know this is beyond ridiculous. We’ll all be here waiting for the update. I hope you get a judge Judy type judge who tears them a new one 😂

weirdoboelady · 13/02/2025 19:22

Looking forward to the update tomorrow! In the mean time, have the best day you possibly can, and remember to spoil yourself and look after yourself x

GargoylesofBeelzebub · 13/02/2025 20:00

Wishing you luck!

sexnotgenders · 13/02/2025 20:03

Another one confessing to being totally overinvested in your thread, OP!

Good luck tomorrow. As everyone else has said, stay calm and focused, and simply let your batshit accusers hang themselves. The judge will see right through this nonsense, so try and enjoy their very public failure, and spoil yourself to whatever your treat of choice is tomorrow evening (after updating your thread of course!!)

OlympicGoldfish · 13/02/2025 20:29

Good luck 🤞

FiveShelties · 13/02/2025 20:43

Just seen this thread, how stupid to waste all that money and time on this.

Good Luck @FBIsMostWanted

TheFormidableMrsC · 13/02/2025 21:12

Will be thinking of you tomorrow OP. You'll be fine! I hope they are sent packing. Good luck! Flowers

Finallyhappyat58 · 14/02/2025 06:14

Hope it goes well today!

Take some deep breaths this morning to calm your nerves. You have done nothing wrong. Maintain your dignity. Take a breath and think about what you want to say in answer to any questions and then say it. Don't worry about fluffing the answer out or filling silences. Just think about your answer and give it.

Hopefully the judge will have a grain of common sense and you'll be in and out quite quickly.

We all stand with you in solidarity!

AppleMacCheese · 14/02/2025 08:04

I've been following though I haven't commented until this point OP, but just wanted to wish you good luck. Just explain everything clearly and the facts will speak for themselves. I hope these irritating fools are given a lesson in wasting everyone's time!

BellissimoGecko · 14/02/2025 08:14

Wishing you all the best today, op! I'm sure it will go your way. Update us when you can!

Almostlegible · 14/02/2025 08:54

Word of advice - allow them to show the judge what idiots they are all by themselves.
So when they interrupt you while you’re addressing the judge, or speak over you, don’t reply, don’t engage, just look at them, then look at the judge and she or he will tell them to be quiet.
Show the judge that you are respectful of their court, and the rules, and are capable to sticking to the facts of the case.
It’s all about the facts but it’s also about reasonableness and if they show themselves for the idiots they are, the judge will see this.
Wishing you all the best.

BrightLightTonight · 14/02/2025 09:15

Good luck for today.

Mumofoneandone · 14/02/2025 09:28

Thinking of you today. Small claims courts are nerve-wracking (had to make a claim against someone). Judges have their heads screwed on tho, so whilst you have to go through the process, it won't do the other side any good!
Just to say the other side might not even turn up - mine didn't in my case!

DancingNotDrowning · 14/02/2025 09:29

Just come across this thread - wishing you the very best. Their sense of entitlement is extraordinary

Quinlan · 14/02/2025 09:34

I can’t believe they didn’t call this off! I remember this thread and really thought that someone along the way would tell them what idiots they were being and they’d give up. But here you are!
Good luck today. I hope you get a sensible judge and it’s all over quickly.

ShelfyElfy25 · 14/02/2025 09:37

Good luck today OP. Hope you get a sensible judge who sees straight through this nonsense!

MoveToParis · 14/02/2025 10:45

I am so looking forward to hearing how they get their arse handed to them.

Hopefully you have booked a lovely dinner to treat yourselves this evening.

EmeraldDreams73 · 14/02/2025 15:23

Just wondering how today went/is going, OP. Everything crossed that the judge sees the blindingly obvious and chucks their claim out. It's ridiculous.

ShelfyElfy25 · 14/02/2025 16:15

@FBIsMostWanted hope you got the right outcome!

Velmy · 14/02/2025 16:51

Anyone else incredibly nervous that OP has been given a massive fine and 10 years in prison? 😅

If it were me I’d still be getting over the stress, and planning on doing an update this evening after sitting down with a large glass of gin. I’m sure she’ll get back to us tonight 🙏😂

SofaSpuds · 14/02/2025 17:10

I've been keeping an eye on this thread, and I'm really hoping OP is back soon with a positive outcome 🤞
