Unfair dismissal

So I started a new job a few months ago, after a few weeks I handed my notice in due to mental health but they persuaded me to stay so I did. Fast forward to this week and I had 2 days off because of my mental health was honest with them as to why I took 2 days off and today they have 'terminated my employment'. Does this sound like unfair dismissal?

Are you still in your probation period?

Bridgetx88 · 24/07/2024 22:52

@Disneydatknee88 I don't think I had a probation period

I don’t think you can claim unfair dismissal if you have been employed for less than two years.

StormingNorman · 24/07/2024 23:11

Statutory protection for unfair dismissal only kicks in at two years.

I’m sorry you’re in this position. The best thing now is to make your exit a good one. Try to negotiate a resignation rather than dismissal, agree a reference and ask for pay in lieu of notice.

You don't have any protection against unfair dismissal. However, you are protected against discrimination. It may be that they should have considered making reasonable adjustments to allow you to stay in the job, but there isn't enough information in your posts to be sure. You should consult an employment lawyer if you want to know if you have a claim. However, think carefully. Going down that route can be very stressful. Walking away from it may be the best option for you.

When I told them I wanted to quit due to anxiety they adjusted my working hours to better suit me so I guess they had already made reasonable adjustments. It's a shame as I was doing so well getting back into work after having my daughter but anxiety got the better of me.

You cannot claim unfair dismissal unless you've been there 2 years or more im afraid. You can claim discrimination but you would have to provide proof of discrimination. (I know because I have recently completed the process of ACAS and tribunal etc for unfair dismissal and discrimination, only last month - I had been there for 3 years). It was awarded in my favour but it is incredibly long and stressful, you need a plethora of evidence - my hair started falling out from the stress of it. My advice would be to walk away.
