Not being paid and accused for no reason

Hi, everyone!

I need a lawyer ASAP. I have been working for this company for 5 years as self employed. They didn’t pay me for the latest 6 months. Now, they are accusing for negligence and faults on the last project. Do you any lawyer that deals with this, please?

So first of all why do you think you were self employed not employed? Is is because they said so or do you actually qualify as SE? HMRC has an online checker.
Secondly if you have been seen as SE with them do you have a contract and on what basis are you SE?
Thirdly what are they actually saying and can you give more information about what has happened?

I’m qualified as SE.
On the last project, floor at the property went bad. I’m a plumber. The company asked me to do even the flooring. During that time, haven’t got too many projects and so I accept it to do it. I even told that that the materials are not the right one. But they told me to continue to finish the job. Now, that owners moved in the property, the floor looks miserable

So you agreed to do a job you aren't qualified for (floor) with the wrong materials and now it is a bad job and you haven't been paid?
I think you do need to bear some responsibility for that but I appreciate if you needed the money and thought you could do it you might have given it a go.
If the customer isn't happy they might not have paid though

Is this the only Company you work for, if it is, they should be paying you through PAYE, you could threaten them you will report them to HMRC for this. Secondly you could email/write to them giving them 2 weeks to pay and if you don’t receive what you are owed, you will put in a claim in Court.

Contractors such as plumbers etc can be on is CIS scheme so not strictly PAYE

@Hoppinggreen When I worked for an Accountant, we had some building trade clients fined if they were solely employing contractors who only worked for them and they had to operate a PAYE scheme for them, I didn’t know this changed in the last 4 years.

This isn’t a place to find a good lawyer. No one knows where you are or the full details. You need to do that for yourself.

You’re a competent grown up adult who can use google and a phone. Call round lawyers in your area and speak to them to find a good fit.

This is complicated. The SE IR35 issue is for another day. If you report to someone and you told them that the materials were wrong, but they told you to continue. Verbally? Or by text? Do you have proof? Your monthly submitted invoices haven't been paid for 6 months? I would write a strongly worded email asking for payment. Your'll have to think about whether you want to go to small claims. and the damage that could do? No more working for them long term because of destroyed trust?

You've come to the wrong place.
I would advise you to independently search your local area.

However, you need to articulate your story better. As you appear to be relying on naivity and ignorance.

Neither of which will help you if this does reach a court.
