Who owns the beach in front of my house

Anyone know anything about the use of the foreshore? I live next door but one to a restaurant and face the beach. The restaurant have just put 2 huge tables wit attached seating so not moveable, along with windbreak and parasols, on the beach directly in front of my house. I asked the Planning department and they said the restaurant was fine to do this as it's an area that people socialise in already. They already have tables on the pathway in front of their restaurant. To me this sounds dodgy and I am trying to pursue it by finding out about beach ownership. I think I read somewhere that the property owner owns the beach above the high water mark in front of their house, and the Crown owns it between high and low water mark. And it can't be used for commercial purposes. Looking for advice before I take this further but don't know what to do next.

I'm no troll! But I'm not putting out a diagram! I am pursuing a number of avenues and this is one. So far people have been thoughtful and some helpful suggestions.

If they are serving alcohol then the space needs to be licensed
Contact the licensing - you can look up applications online usually as well

I appreciate this but unfortunately the pavement licensing laws do not cover it as it's not a pavement or in the town. It seems to be a grey area.

They have tables in front of their property too! But not on the beach.

They are being a bit cheeky and have notices saying you can't sit there - at the very least this is public space so can't see how they can stop people sitting there with their own stuff! It's not even in front of their restaurant but one and two doors down!!

I'd not only be sitting there, I'd be getting the BBQ out and inviting a load of friends over and there's nothing they can do about it, actually I'm an arsehole and I'd really enjoy messing them about tbh 🤷‍♀️ they'd tire of it before I would 💐

OP- I agree that @Springwatch123 was making a joke. You will find on MN that people often ask for a diagram to make it easier to visualise what the issue is. Here are my suggestions:

  1. Use the table yourselves for every meal
  2. Install a speaker hidden behind shrubs and play squawking seagull sounds at the times you aren't using the table yourselves
  3. Leave fake dog poo around the table legs and on the seats
  4. If you don't use the table, hide a few rotten bones/prawn heads in the sand underneath. The flies will LOVE them!
  5. If your frontage has grass, install a sprinkler that accidently goes off when the restaurant staff come past and accidently faces their table. 😂

I’d be drumming up support from other locals as well. Pointing out the restaurant don’t own the land, if you’re sure they don’t, and that they’re restricting access. Get on Facebook

I'm not going to insist on a diagram, but I'm confused about the situation of the house between you and the restaurant. Are there tables in front of that house?

I think if they are serving food and alcohol outside they need a license so would go to planning armed with photos of people drinking, eating, videos of them etc.

I would also be putting a ring door bell as you may now encounter anti social alcohol led behaviour unfortunately.

Finally i would be letting the kids loose with water guns and let them squeal and play as much as they fancy. Have a big party outside frequently with lots of lots music to.

The foreshore is the area between the high and low water mark on the seashore, so if the tables are on the foreshore they won't be for long!

If they are on the beach, your deeds will tell you whether you own the beach area - we used to live in a small road where each property owned the roadway in front of their property, to the middle of the road. It made maintenance interesting!

I've often been envious of houses that faced the beach. Not so much now though.

We aren't allowed to take stones or rocks from the beach, but anyone can just plonk (commercial) tables on the sand for a business? That cannot be right. I am sure other businesses in the area will be watching this also.

Is your "but one" neighbour's house part of the restaurant or a separate holiday home or a full time dwelling? What have they to say about the situation, it must surely be impacting them also.

Sounds like it could be impacting on your use of your property, so maybe covered by a number of laws.
Interesting that they have been intimidating towards you - may mean they know they are behaving illegally/poorly towards a neighbour but hope you won't take it further.
Maybe keep a note of interactions in case it borders on intimidation or log with local police if you feel unsafe.
