Restriction on Deeds

Hi, sadly my mum passed away in January and myself and my son are the beneficiary of her estate,but mum had an executor too.Now from day one I've been kept in the dark , just updates as and when.I wanted a smooth sale of mums house which it did , but after the house has been emptied the executor says there's a problem on a "Restriction on the Deeds" I've looked on gov website and downloaded this info and it's only telling me my mum's name linked with "Nationwide" in 2006 , my mum's house is fully mortgage free and I'm just so puzzled why this restriction is in I feel this sale will fall through because of it , any help I'd be very grateful

It could be that your mum left £1 outstanding on the mortgage so the deeds were kept in safe storage by the Nationwide. It was quite common at one stage but NW still appeared on the deeds in some format. That all stopped a while ago when deeds went electronic but Nationwide may not have sorted out the paperwork.

I'm still confused , my mum and dad's mortgage was not with Nationwide , it was The Halifax , at one point the only connection was either mum had either her salary paid in there or she had a savings account , with me not being able to ring The Executor because I don't "wanna loose" it with that side of the family yet , their day of karma will arrive I assure you , I'd give every penny away if I could get 1 more hour with my mom, I just want this over with so I can look forward,not backwards

It might be an idea to look at the Land Registry ( make sure it is the .gov one) and iirc there is an indication of restrictions on there. You can download documents showing restrictions for a fairly nominal fee.

Could your Mum have taken out a mortgage with Nationwide or equity release and not informed you?
